The Creators’ Lab Liability Waiver & Use Agreement
This Liability Waiver & Use Agreement (“Agreement”) is entered into by and between Visionary Studios and the undersigned participant, renter, guest, organization, production team, vendor, attendee, or representative (“User”) for the use of The Creators’ Lab located within Visionary Studios.
By signing this Agreement, User acknowledges and agrees to the following terms and conditions:
1. Assumption of Risk
User understands and acknowledges that participation in activities, events, productions, rehearsals, workshops, meetings, photo/video shoots, performances, installations, content creation, and general use of The Creators’ Lab may involve certain inherent risks, including but not limited to:
Personal injury
Property damage
Equipment malfunction
Slips, trips, and falls
Electrical hazards
Damage caused by other guests or attendees
Theft or loss of personal belongings
Exposure to loud music, lighting equipment, staging materials, or production equipment
User voluntarily assumes all risks associated with entering and using the premises.
2. Release of Liability
To the fullest extent permitted by law, User releases, waives, and discharges Visionary Studios, its owners, operators, employees, contractors, representatives, affiliates, volunteers, and partners from any and all liability, claims, demands, damages, costs, or causes of action arising from or related to:
Injury to persons
Death
Loss or theft of property
Property damage
Accidents occurring on the premises
Use or misuse of equipment or facilities
Actions of guests, vendors, attendees, or third parties
This release applies whether caused by negligence or otherwise, except in cases of gross negligence or intentional misconduct.
3. Responsibility for Guests & Attendees
User accepts full responsibility for all guests, vendors, attendees, performers, contractors, and collaborators brought onto the premises.
User agrees to:
Ensure all guests behave respectfully and safely
Monitor noise levels and activity
Prevent illegal activity, violence, harassment, or unsafe conduct
Be financially responsible for any damages caused by User or User’s guests
Visionary Studios reserves the right to remove any individual acting in a disruptive, unsafe, threatening, or inappropriate manner.
4. Property Damage & Cleanliness
User agrees to return The Creators’ Lab in the same condition it was received.
User may be charged for:
Damaged furniture or fixtures
Wall damage
Excessive trash or cleaning
Damage to equipment
Missing items
Unauthorized modifications or installations
Failure to properly close or secure the space
User understands that additional cleaning, repair, or replacement fees may apply.
5. Equipment & Technical Use
Any equipment, lighting, sound systems, furniture, props, staging, décor, or technical materials used within The Creators’ Lab are used at User’s own risk.
Visionary Studios does not guarantee compatibility, functionality, or uninterrupted operation of any equipment or internet services.
User is responsible for ensuring all third-party equipment brought into the space is safely installed and operated.
6. No Illegal or Prohibited Activities
The following activities are strictly prohibited:
Illegal drug use
Weapons of any kind
Smoking indoors
Open flames or pyrotechnics without written approval
Illegal activity of any kind
Excessive occupancy beyond approved limits
Activities that may damage the property or disrupt neighboring tenants
Violation of these terms may result in immediate termination of access without refund.
7. Booking & Space Usage Policies
Use of The Creators’ Lab must be approved and confirmed by Visionary Studios prior to use.
Submission of an inquiry or verbal discussion does not constitute a confirmed booking.
A booking is only considered confirmed once:
Approval has been granted by Visionary Studios
Any required payment has been made
A calendar invitation or written confirmation has been issued by management
There is an actual event, production, rehearsal, meeting, or studio usage taking place within the approved timeframe
Visionary Studios reserves the right to deny, modify, or revoke bookings at its discretion.
8. Photography, Video & Media Release
User understands that events or activities occurring within The Creators’ Lab may be photographed or recorded.
Unless otherwise agreed upon in writing, Visionary Studios may use photographs, videos, or media captured within the space for promotional, marketing, social media, archival, or business purposes.
User represents that they have obtained any necessary permissions or releases from attendees, performers, or guests associated with their booking.
9. Indemnification
User agrees to indemnify, defend, and hold harmless Visionary Studios and its affiliates from any claims, liabilities, damages, legal actions, costs, or expenses arising from:
User’s use of the space
User’s guests or attendees
Violations of this Agreement
Damage to property
Injury occurring during User’s booking or occupancy
10. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of California.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
11. Acknowledgement
By signing below, User acknowledges that:
They have read and understood this Agreement
They voluntarily agree to its terms
They understand they are waiving certain legal rights
They are at least 18 years old or are signing through a parent/legal guardian
